Covered Vaccines

Understanding which vaccines may fall within the federal compensation programs and why the current table matters.

The VICP applies to vaccines included in the federal Vaccine Injury Table. The table identifies covered vaccines, compensable injuries, and the required time period between vaccination and symptom onset. It can be amended, so the version and rules in effect for the relevant vaccination must be reviewed.

Coverage is not determined by the vaccine name alone. The formulation, route, date, injury, and medical evidence may all affect the analysis.

Vaccine categories commonly addressed by the VICP

  • Diphtheria, tetanus, and pertussis vaccines
  • Measles, mumps, and rubella vaccines
  • Polio, hepatitis A, hepatitis B, and Haemophilus influenzae type b vaccines
  • Varicella, pneumococcal, meningococcal, and rotavirus vaccines
  • Influenza and human papillomavirus (HPV) vaccines
  • Other vaccines or combinations listed in the applicable version of the table

VICP and CICP are different programs

COVID-19 vaccines have generally been addressed through the Countermeasures Injury Compensation Program (CICP), rather than the VICP, subject to the rules and coverage in effect for the claim. The programs have different eligibility requirements, procedures, and deadlines.

Because the federal tables and program rules can change, a current review is important before assuming that a vaccine or injury is covered or excluded.

Gather the details early

Keep the vaccination record, lot information if available, appointment notes, symptom timeline, diagnoses, and treatment records. These details help determine which program and legal theory may apply.
