Undue Influence

Investigating whether an estate document or financial decision was procured through pressure that overcame a person's free will.

Undue influence is more than ordinary persuasion or a difficult family relationship. It may arise when a person uses a position of trust, dependency, isolation, or control to obtain a document or transaction that does not reflect the other person's independent wishes.

We look at the full relationship and timeline, including vulnerability, access, secrecy, benefits received, and the circumstances surrounding the decision.

Circumstances that may raise concern

  • A sudden change in a will, trust, power of attorney, account, or beneficiary designation
  • Isolation from family, friends, advisors, or other sources of independent advice
  • A caregiver or confidant controlling transportation, communications, finances, or access
  • Secrecy around document preparation or a signing arranged by the person who benefits
  • A plan that is inconsistent with the person's long-held statements, relationships, or prior documents

Looking beyond a single event

Undue influence is usually evaluated through circumstances rather than one piece of evidence. Medical records, financial statements, texts, emails, calendars, witness accounts, and earlier estate plans can help show how the relationship and decision developed.

Relief and next steps

Depending on what happened, a claim may seek to invalidate a document, restore property, compel an accounting, or protect a vulnerable person from ongoing harm. Prompt review is important because probate and financial proceedings have procedural deadlines.
