Will Contest Claims

Challenging a will's validity when the document may not reflect a person's informed and voluntary wishes.

A will contest asks whether a will should be admitted and enforced. A sudden change, an unusual distribution, or a document prepared when a person was vulnerable can raise serious questions, but the facts and evidence must be carefully evaluated.

We help interested parties understand their standing, identify the governing deadlines, and assess whether a challenge is supported by the record.

Potential grounds for a contest

  • Lack of testamentary capacity at the time the will was signed
  • Undue influence, fraud, duress, or coercion
  • Improper execution or questions about the document's authenticity
  • A later will, revocation, or other evidence that changes the analysis
  • Mistakes or circumstances suggesting the document does not express the testator's intent

Testamentary capacity is time-specific

The relevant question is generally the person's understanding when the will was executed. Medical diagnoses alone do not answer that question, and a person may have had good and bad periods. Medical records, the drafting attorney's file, witnesses, and the surrounding timeline can all be important.

Protecting your position

A probate notice, will, or court filing may trigger a short response period. Preserve the documents you have, avoid altering originals, and seek advice promptly so that procedural rights and relevant evidence are not lost.
