Fiduciary Duty Litigation

Holding executors, administrators, trustees, and other fiduciaries accountable when trust is misplaced.

A fiduciary is entrusted to protect property and act for the benefit of others. When an executor, administrator, trustee, or agent puts personal interests ahead of those responsibilities, beneficiaries and heirs may need a clear legal response.

We help clients examine the conduct at issue, preserve important records, and pursue a practical resolution that protects the estate or trust.

Common fiduciary disputes

  • Failure to collect, safeguard, or distribute estate or trust assets
  • Self-dealing, conflicts of interest, or transactions benefiting the fiduciary
  • Unexplained payments, excessive compensation, or misuse of funds
  • Failure to communicate with beneficiaries or provide required information
  • Preferential treatment, concealment, or decisions that disregard the governing document

Accountings, surcharge, and removal

An accounting can bring structure to incomplete or confusing financial information. We review statements, transfers, receipts, appraisals, and distributions to identify what is missing and what may require explanation.

Depending on the facts and the governing document, a court may be asked to order an accounting, surcharge a fiduciary for loss, or remove and replace a fiduciary whose continued service threatens the estate or trust.

A careful, evidence-based approach

Fiduciary litigation often turns on a timeline: who had authority, what information was available, what transactions occurred, and when beneficiaries learned of them. We work to organize that record and explain the available paths before taking the next step.
