Testamentary Capacity

Determining whether a person understood the estate document they signed and the people it affected.

Testamentary capacity is a focused legal question. It concerns a person's understanding when a will or related testamentary document was executed, not simply whether the person had a diagnosis, was elderly, or later experienced cognitive decline.

When capacity is questioned, we examine the person's condition, the drafting process, the document itself, and the witnesses who observed the signing.

The questions that matter

  • Did the person understand that they were making or changing an estate document?
  • Did they generally understand the property or assets involved?
  • Did they recognize the people who would ordinarily be considered in the plan?
  • Could they form a coherent plan and communicate a voluntary decision?

Evidence from the signing date

Medical records near the execution date can be useful, but they are only part of the picture. The attorney's notes, witness testimony, messages, daily observations, medication history, and changes between documents may help establish the person's actual functioning at the relevant time.

Capacity and other challenges

Capacity concerns often overlap with undue influence, fraud, or improper execution. We help distinguish those theories, identify what must be proven, and preserve the records needed for a fair evaluation.
